These Terms of Use (hereinafter referred to as the Terms) apply to all users of the ONLINE MUSEUM OF TRADITIONAL ART OF UKRAINE – KROVETS https://krovets.ua (hereinafter referred to as the Site), including those who, under the terms specified below, have subscribed to pay a regular charitable contribution.

1. GENERAL PROVISIONS

1.1. The non-governmental organization “Krovets” (hereinafter referred to as the Site Operator), under these Terms provides users of the Site with the opportunity to familiarize themselves with and view the Site to the extent and with limited access to certain content of the Site, determined at the discretion of the Site Operator.

1.2. To support the Site Operator's operations under its Statute, the User may subscribe to pay monthly charitable contributions to the Site Operator. Such operations, in particular, but not exclusively, relate to promoting the proper collection, preservation, research, accounting, and publication of samples of Ukrainian folk art.

2. SUBSCRIPTION

2.1. Only an individual (not an organization or a legal entity) who has reached the age of 18 can subscribe to the payment of monthly charitable contributions (hereinafter referred to as the Subscription).

2.2. The Site Operator has the right to set the three options for the amount of monthly charitable contributions; information about these options is displayed on the Site. When subscribing, the User selects the desired option for the amount of the monthly charitable contribution.

2.3. Monthly charitable contributions are debited to the User's bank card automatically each month, without separate confirmation of each payment by the User. Monthly debiting is carried out on the same day of each month when the subscription was registered. If the monthly debit was not successful, the payment system may make several additional debit attempts later.

2.4. The User may select another option for the amount of the monthly charitable contribution from the available options. The changed amount of the monthly charitable contribution will be debited from the following month.

2.5. To complete the subscription, the User must sign in, pay the charitable contribution, and sign for regular monthly debits in the amount of the selected monthly charitable contribution option.

2.6. For signing in, the User has to provide the Site Operator with the following information: last name, first name, patronymic, e-mail, and phone number, and has to accept Community Standards, these Terms of Use, and Terms of Purchase of Photo-reproductions.

2.7. The Site Operator accepts payments through the payment method (valid bank card details) that the User specified during signing in and making the first payment. The User must register a valid and acceptable payment method (a valid bank card).

2.8. To process payments, the Site Operator may use the payment system provided by a third-party payment system provider. By making a payment, the User agrees to the terms of service of the payment system. The Site Operator is not responsible for the operation or inoperability of the payment system providers and for the functioning or malfunctioning of the payment systems. 

2.9. By subscribing, the User confirms that they are familiar with the provisions of these Terms of Use, Terms of Purchase of Photo-reproductions, and Community Standards and agrees to comply with the conditions and restrictions specified in all these documents.

2.10. Under these Terms of Use, Users have the right to view and familiarize themselves with the following content of the Site:

(a) text information about each exhibit presented on the Site;

(b) a set of selected drop-down field values for describing the characteristics and attribution of each exhibit;

(c) the title photo-reproduction for each exhibit (no more than 700kB in size);

(*) summarized fixed infographics 

(hereinafter all referred to as the Basic Content of the Site).

2.11. Registered Users who have paid a monthly charitable contribution under these Terms of Use are also entitled to view and familiarize themselves with Additional content on the Site, which includes:

(d) additional photo-reproductions of all exhibits in low quality (300 pixels by 300 pixels);

(e) summarized infographics with the ability to apply filters; 

(hereinafter all referred to as the Additional Site Content).

Registered Users under these Terms of Use are also entitled to use the Additional Functionality of the Site, in particular:

(1) the ability to gather additional photo-reproductions they like into the mood board in their user account;

(2) an additional optional ability (subject to successful verification of the identity and signing of the relevant Additional Agreement on the right to purchase photo reproductions through the “Vchazno” Service) to purchase watermarked (with the User’s full name and TIN indicated in the watermark) additional photo-reproductions (images) of exhibits in high quality (up to 700kB) for an additional fee. THIS ADDITIONAL OPTIONAL ABILITY TO PURCHASE PHOTO-REPRODUCTIONS IS ONLY AVAILABLE FOR CITIZENS OF UKRAINE WITH A VALID ELECTRONIC DIGITAL SIGNATURE;

(hereinafter all referred to as the Additional Functionality of the Site).

2.12. The Basic and the Additional Content (hereinafter referred to as the Site Content) is provided for personal non-commercial use only. The User undertakes not to violate this provision. Personal non-commercial use in these Terms of Use in particular mean the use of the design of the exhibit (the item depicted in the photo-reproduction) to create a single similar or derivative item or product for personal use without the right to sell such an item or product and without the right to mass produce it for any other purpose including free gifting, donating, etc.

2.13. The User shall undertake the following:

2.13.1. not to use the design of the exhibits depicted in the photo-reproductions to create: hand and machine embroidery pattern schemes, replicas, and/or product designs that will be intended for sale or mass production for any other purpose (free gifting, donating, etc.) in person or with the involvement of third-party contractors;

2.13.2. not to use the photo-reproductions for public displays, not to distribute to the general public, including through social networks, both for commercial purposes and without;

2.13.3. not to transfer, sell and/or donate the photo-reproductions to third parties;

2.13.4. not to use the photo-reproductions in published and printed products such as books and book covers, magazines, newspapers, editorials, newsletters, video programs and theatrical performances, etc.;

2.13.5. not to place the photo-reproductions in the public domain;

2.13.6. not to use the photo-reproductions for training artificial intelligence (AI) models and related content creation.

[NOTE: All rights for any public or commercial use of the Content (especially photo-reproductions) for personal or with the involvement of third-party contractors use of the design of the exhibit depicted in the photo-reproductions, to create: embroidery patterns schemes, replicas and/or product designs that will be intended for sale or serial production for any other purpose (free gifting, donation, etc.), as well as for training AI models - belong to the Content Owners.

To purchase licenses for any public or commercial use of the Content (especially photo-reproductions) - contact the Content Owners.

The Site Operator may disclose the contacts of the Content Owners upon their consent.]

2.14. If, due to the expiration of the bank card or for any other reason, the Site Operator fails to collect the due charitable contribution, the User will be limited in access to the Additional Content and Additional Site Functionality. In such a case, the Site Operator may send the User a corresponding notification.

3. SUBSCRIPTION TERMINATION

3.1. The subscription will continue until its termination.

3.2. The User may cancel the subscription at any time in the user’s account. Availability of the Additional Content and Functionality will terminate after the expiry of the period covered by the recent charitable contribution.

3.3. The Site Operator may, at its sole discretion, periodically change the options for the amount of monthly fixed charitable contributions. Such changes will apply only after the Site Operator sends the User a corresponding notification. If the User, after receiving such notification, does not wish to continue making contributions under the updated terms, they may cancel the subscription before the beginning of the next period (month).

3.4. All monthly charitable contributions paid by the User during the entire period of the subscription are not subject to reimbursement.

4. PRIVACY POLICY

4.1. The Site Operator has the right to collect, store and process any information that the User provides during registration and subscription and in the process of using the Site. Such information includes, in particular, but not exclusively: last name, first name, patronymic, e-mail and phone number, login to the personal account, the User's data in the "Vchazno" Service, the address for sending the invoice, bank card number, etc.

4.2. By submitting own personal data, the User gives the consent to the processing of his personal and other data by the Site Operator, as well as his agreement with the terms of section 4 of these Terms of Use.

4.3. When the User visits the Site, the Site Operator may collect certain information, including: IP address, time of visit, browser type and language version, information about the User's navigation of the Site, as well as actions on the Site.

4.4. The User's personal information is collected and used by the Site Operator for the following purposes:

■ creation, administration and maintenance of a personal account;

■ processing the actions and operations of the User on the Site;

■ data analysis and statistical research to improve the Site operations;

■ marketing communications for promotion and advertising;

■ other purposes not prohibited by laws and regulations.

4.5. Users may, if they wish, refuse to receive advertising and informational mailings from the Site Operator; for this, they only need to click on the appropriate option in the message.

4.6. The User's personal data is stored for the period necessary for their processing.

4.7. The User has the right to withdraw their consent to the processing of personal data at any time by sending a message of the appropriate content in any form to the email address krovets@hotmail.com. In this case, some functions of the Site may remain unavailable, and the Site Operator will store and use information only to the extent necessary to comply with the current legislation of Ukraine, prevent fraud or other offenses, and resolve disputes.

4.8. The User has the rights of a personal data subject under the "Personal Data Protection" Law.

4.9. The Site Operator undertakes to maintain the confidentiality of the Users' personal data, taking into account the provisions of these Terms of Use and the current legislation of Ukraine.

4.10. Access to the User's personal data may be granted to authorized employees of the Site Operator who have consented to the confidentiality of users' personal data, as well as third parties who provide the Site support and maintenance services, payment processing, and other services related to the Site Operations. These authorized employees and/or third parties, based on agreements concluded with the Site Operator, undertake to comply with all requirements of the current legislation of Ukraine regarding the protection of users' personal data and their confidentiality.

4.11. The Site Operator may disclose the User's personal data if this is required by the legislation of Ukraine, and if the Site Operator's refusal to make such disclosure will be considered as a violation of these legal requirements.

4.12. The Site Operator ensures the execution of all relevant confidentiality obligations specified in these Terms of Use and the in legislation of Ukraine, and also ensures the application of technical and organizational security measures to prevent unauthorized and/or unlawful disclosure or processing of the User's personal data, unlawful access to them, their accidental loss, destruction or damage.

5. OTHER PROVISIONS

5.1. The User is obliged to read these Terms of Use, Terms of Purchase of Photo-reproductions and Community Standards before each use of the Site. If the User uses the Site, after the publication of the changes or amendments to these Terms of Use, Terms of Purchase of Photo-reproductions and Community Standards, this means that they have accepted all the changes in all these documents. If the User does not agree with any of the provisions of these Terms of Use, Terms of Purchase of Photo-reproductions and the Community Standards, they should immediately stop using the Site.

5.2. If any provision of these Terms of Use is declared invalid or illegal, the other provisions of these Terms of Use remain valid and legal in full.

5.3. The Site Operator reserves the right to make changes and additions to the Terms of Use as a whole or to any part of them at any time. Such changes become effective upon their publication. If the User continues to use the Site after such changes become effective, that means that the User accepts all changes. If at any time the User can no longer comply with these Terms of Use, Terms of Purchase of Photo-reproductions and Community Standards, the User must immediately stop using the Site and its Content, as well as terminate the subscription if it is active.

5.4. The Site Operator may send the User information related to the account (for example, payment authorization, invoices, change of password or payment method, confirmation message, notification), in the form of an e-mail to the User's e-mail address specified during registration.

5.5. The Site Operator has the right to block or suspend, in whole or in part, the registered User's access to the Site Content if:

■ The User significantly or repeatedly violates these Terms of Use, Terms of Purchase of Photo-reproductions or Community Standards;

■ The Site Operator is obliged to do so under the requirements of the current legislation of Ukraine or by court decision;

■ The Site Operator has reasonable grounds to believe that the User has committed actions that may cause the Site Operator or its partners to be held liable or otherwise harm them.

5.6. The username (login) and password chosen by the User when registering on the Site are confidential information. The User is aware of the need not to disclose this information and is obliged to keep it a secret, not to disclose, not to transfer it to third parties or related parties and not to disclose their personal data and not to let other parties to their user account.

5.7. The User, as the owner of the login and password, always uses the login and password personally and under no circumstances may transfer the login, password and access to the user account of the Site to any third parties.

5.8. The User confirms that as the owner of the login and password, it is only the User, who is personally responsible for each Site visit and every use of the Content. The User also understands and agrees that the Site Operator automatically recognizes the entry of his login and password as evidence and indisputable proof of the fact that it was the User who received access to the personal account and the Basic and/or Additional Site Content.

5.9. The User confirms that he does not intend to use the Content for any illegal or fraudulent, or unlawful purpose.

5.10. The User undertakes to refrain from using the Site in a manner that may cause damage to it, disruption of its operation, or other negative consequences.

5.11. Under no circumstances may all monthly charitable contributions paid by the User for the entire period of the subscription be returned or reimbursed.

5.12. The Site may contain links to third-party sites. Such links are provided solely for the convenience of the User. Their presence does not mean that they are recommended or approved by the Site Operator. In addition, the Site Operator does not guarantee that these third-party sites are safe and meet the User's expectations. The Site Operator is not liable for any damage or loss, direct or indirect, arising in connection with visiting third-party sites accessed using links posted on the Site.

5.13. The validity, and interpretation of these Terms of Use, and legal relations arising in connection with the execution or violation of these Terms of Use, are regulated by the legislation of Ukraine.

5.14. The Site Operator has the right (without notice at any time and for all or any individual User, or any group of users): to suspend or terminate the operation of the Site or any section of the Site, to change or deactivate any functionality of the Site, to suspend or terminate access to any Content, to suspend or terminate the possibility of paying for and downloading any the Content. Such actions of the Site Operator in no way violate the rights of Users, and in particular do not limit the rights of Users who have subscribed to the payment of regular charitable contributions, and the charitable contributions paid by them are not subject to return or reimbursement.

Under all circumstances, the Ukrainian version of these Terms of Use prevails.
